Rhapsody Referral & Incentive Program – Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN THE RHAPSODY REFERRAL & INCENTIVE PROGRAM. BY PARTICIPATING IN THE PROGRAM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS (“Terms”).
1. Overview
Rhapsody Solutions LLC (“Rhapsody,” “we,” “us,” or “our”) offers the Rhapsody Referral & Incentive Program (“Program”) to eligible participants (“Referrer,” “you,” “your”) on the terms and conditions described herein. These Terms govern how you may earn referral incentive payments (“Incentives”) for referring new organizations, ensembles, or independent contractors (“Referee”) to Rhapsody in accordance with the rules below.
Participation in the Program constitutes your acceptance of these Terms. Rhapsody reserves the right to modify, suspend, or terminate the Program or these Terms at any time, with or without notice.
2. Eligibility
To participate in the Program and earn Incentives, you must:
Be at least 18 years of age;
Be a legal resident of the United States;
Provide accurate and complete information when participating in the Program; and
Not be prohibited from receiving payments under applicable law.
Participation is void where prohibited by law. Rhapsody may disqualify any Referrer at its sole discretion.
3. How the Program Works
a. Referral Process
To refer a new organization, ensemble, or independent contractor (“Referee”):
The Referee must book a demo with Rhapsody and during that demo, identify exactly ONE person as the individual (“Referrer”) who is recommending Rhapsody.
The Referee must sign up for Rhapsody services following the demo.
A referral is only valid if the Referee (i) has not previously been a Rhapsody customer and (ii) clearly identifies you as the Referrer during the demo.
b. Earning Incentives
Once a valid referral is made:
Upon the Referee signing up and Rhapsody receiving the organization’s deposit, the Referrer will earn $250 (“First Incentive Payment”).
After the Referee has actively used Rhapsody services for six (6) consecutive months, the Referrer will earn the remaining $250 (“Second Incentive Payment”).
Maximum total Incentive per valid referral is up to $500.
Incentive payments may be subject to verification and validation by Rhapsody before payment. Incentive amounts are determined by Rhapsody in its sole discretion.
4. Payment Terms
Incentive payments will be sent via a payment method selected by Rhapsody (e.g., PayPal, bank transfer). You are responsible for providing accurate payment information. Rhapsody is not responsible for lost or misdirected payments due to inaccurate information provided by Referrer.
You are responsible for all applicable federal, state, and local taxes on any Incentives you receive. Rhapsody is not responsible for withholdings or taxes related to Incentives.
5. Restrictions and Conduct
You agree not to:
Engage in any fraudulent or deceptive practices to generate referrals;
Refer yourself, create bogus referrals, or provide false information;
Disclose sensitive or private information about Referees;
Take actions that violate law, or that harm Rhapsody’s reputation.
Rhapsody may suspend or terminate your participation in the Program if it determines, in its sole discretion, that you have breached these Terms or engaged in inappropriate conduct.
6. Confidentiality and Privacy
Rhapsody will handle personal information in accordance with its Privacy Policy. By participating in the Program, you agree to the collection, use, and disclosure of your information as necessary to administer the Program.
7. Independent Contractor
Participation in the Program does not create any employment, partnership, joint venture, or agency relationship between you and Rhapsody. You act as an independent party. You are solely responsible for any tax obligations arising from Incentive payments.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RHAPSODY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY RELATED TO THE PROGRAM OR THESE TERMS. IN NO EVENT SHALL RHAPSODY’S TOTAL LIABILITY EXCEED THE TOTAL INCENTIVES PAID TO YOU UNDER THE PROGRAM.
9. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from the Program shall be resolved in the appropriate state or federal courts located in California.
10. Amendments and Termination
Rhapsody may modify or terminate the Program or these Terms at any time at its discretion. Continued participation in the Program after any modifications constitutes acceptance of those changes.
